TERMS AND CONDITIONS

• This "Superdry Morgan - Contest" ("Contest") is brought to you by Superdry India ("Superdry") in support of "Facebook" and "Twitter".
• Contest is open from 23/10/2012 to 03/11/ 2012 ("Contest Period")
• Contest is restricted to the authenticated / valid members of Twitter who are residents of India and attained age of 18 and above(Participants)
• To participate in the Contest participant needs to tweet about "Superdry Morgan" either on Twitter directly or through the tweet link on www.superdrymorgan.com by "#SuperdryMorgan"
• The comment / views / tweets / text messages submitted by any individual Participant under this contest or otherwise shall be treated as his / her own independent personal views and submissions;
• Superdry and its affiliates do not acknowledge or agree with any such content and further shall not be held liable for any defamatory, abusive language used and loss occurring to any third party.
• Based upon the comment / share / tweets / text messages submitted by the individual Participants,Superdry shall at its sole discretion shortlist and select the best entries and post them on www.superdrymorgan.com.
• Entries posted on www.superdrymorgan.com are only eligible for selection under Contest. Tweets with "#SuperdryMorgan" shall be considered for counting and unlocking the prize slab no. as mentioned at Clause 13.
• The participant warrants that the view is solely his/her original, not an infringement of any person's copyright, unpublished work and it has not been previously entered in any competition or won any award.
• Superdry does not exercise any control, nor does it have the means for exercising this control, amongst others, regarding the quality, originality, authenticity, legality, security or validity of the comment / share / tweets / calls / text messages.
• Superdry reserves its right, without incurring responsibility for the participant or any other person, at all times, and without prior notice, to remove any comment / tweet/view/ text message that is contrary to these Conditions and/or to interrupt access / deny access of such participant to the Contestand shall be under no obligation to provide any benefits accrued under the Contest.
• Superdry reserves its right to modify the language of the comment / view / tweet / content without permission from the Participant, before posting the same on www.superdrymorgan.com
• Winners shall be declared at every stage when the prize is unlocked on number of tweets within a day or on such other day as may be decided by Superdry. Selection shall be done on the basis of the best entries/responses.
• Participants are requested to be accustomed, satisfy and agree to with these terms and conditions of the Contest each time they access the website before participating in or tweeting in relation to this Contest
• Winners shall be selected by random selection from the lot of entriesposted on www.superdrymorgan.com during the Contest period as per unlock schedule. Superdry shall not be responsible any manner whatsoever for non-receipt of requisite no. of tweets.
• Superdry shall not be responsible if the Email Id and the contact details of the Participants incorrect or if the winner is unavailable at the address/details given on the website despite reasonable attempts being made to inform him/her through mailer.
• Superdry reserves its right: (a) to disqualify any Participant /Winner if it has reasonable grounds to believe the Participant /Winner has breached any of the terms and conditions. (b) to decide whether an alternative Winner should be selected in the event any Participant is disqualified from the Contest. (c) to require written permission from the parent or guardian of a winner who is under the age of 18.
• Prizes shall be delivered at the doorstep of the Winner by post/courier as per the postal address confirmed by the Winner to Superdry within 15 days from the date of announcement of the winner, subject to submission of proof of photo identity document as acceptable to Superdry. In the event of failure to receive the prize from post/courier by the winner at its given postal address the Prize will be forfeited and Superdry shall not be held responsible.
• Winner shall be solely responsible for inspecting the conditions of the Prize at the time of receipt and inform Superdry if the same are broken or damaged. No subsequent claims with regard to the Prize shall be entertained.
• Product liability, guarantee & warranty shall be transferred as received from respective Manufacturer & Distributor. Superdry neither warrants nor guarantees the quality, merchantability or suitability of prize given under this offer.
• The participant shall not damage intellectual property rights belonging to Superdry or third parties.
• Contest is subject to force majeure events and situations beyond control of Superdry and its business associates.
• Superdry takes no responsibility for the damages that the user Participant may suffer due to errors or omissions affecting website content.
• By participating, participant agrees that Superdry or its affiliate may intercept and monitor any communication / tweet / call / text message that are made to the extent allowed by law.
• Participant hereby authorizes Superdry to communicate with him / her from time to time about the matters connected with the Contest.
• Employees of Superdry, Group Companies, affiliates or anyone connected with the contest and their families or employees are not eligible to take part.
• Superdry reserves its right to modify these Terms & Conditions without any prior notice. An updated version of the same shall be available on the website.
• The benefits/prizes under the Contest are non-refundable, non-transferable and cannot be exchanged for cash.
• Participant shall indemnify Superdry or its affiliate from any loss that may occur to Superdry
• Participation in the Contest is purely voluntary and at the sole discretion of the individual member/participant.
• Nothing in these conditions implies any association or corporate binding between the Participant, Superdry, Facebook and Twitter, nor can this be considered any kind of joint venture.
• Liability of Superdry shall be limited to the extent of the benefit/prize under Contest to which a Winner participant is entitled under the conditions of Contest.
• By participating in this Contest, Participants agree to be bound by these terms & conditions and waive any right to claim ambiguity in these terms & conditions.
• Participants agree to release, discharge, indemnify and hold harmless Superdry and its directors, officers, employees and agents, from and against any claims, damages or liability resulting in whole or in part, directly or indirectly due to non-adherence of the terms and conditions or due to submission of abusive, defamatory comment / views / tweets / content submitted for the contest by the Participants or use of website to participate in the contest or acceptance of any prize and/or participation in the Contest.
• Superdry reserve its right to use , display, publish, announce or refer the entries/tweets or details or photograph or name ("Material") of any Participant under the Contest in electronic or print media or any other media as they may deem fit. By participating in the Contest the Participant hereby unconditionally agrees to the same, without any cost to Superdry.
• Decision of Superdry in respect of Contest, selection process, benefits/prizes, usage of tweets / entries or any matters related thereto shall be final and binding and no correspondence will be entertained in this regard.
• All disputes are subject to exclusive jurisdiction of the competent courts in Mumbai only.
• Participant unconditionally agrees that he/ she shall not:
• (i) do anything which violates any of the Terms. (ii) make any Misrepresentation. (iii) do anything that does not comply with generally accepted Internet etiquette including (without limitation) the excessive use of inflammatory or antagonistic criticism ("flaming"), or wastefully and unnecessarily including previous communications in any postings.(iv) perform System Abuse. (v) propagate, distribute or transmit Destructive Code, whether or not damage is actually caused thereby (vi) Post abusive, obscene, threatening, harassing, defamatory, libelous, offensive or sexually explicit material.(vii) Intentionally make false or misleading statements. (viii) Offer to sell or buy any product or service. (ix) Post material that infringes copyright. (x) Post information that he/ she knows to be confidential or sensitive or otherwise in breach of the law.
• All rights as to choosing the winner vest with Superdry and shall be done as per the procedure adopted by Superdry with or without supervision of any third party.
• Whenever called for, Participant will be required to complete all formalities as may be communicated by Superdry or its affiliate including but not limited to providing his/her authentic and correct information, failing which he/she shall be disqualified at any time or at any stage. In case false information is revealed at any time after participation, the Participant shall be liable to return all benefits provided under the Contests.
• Superdry reserves the right to restrict / bar any person from participating in the Contest without quoting any reasons for the same.
• The Contest can be discontinued or modified at any time at the sole discretion of Superdry without stating any reasons; no claim in this regard shall be entertained.
• Participants found indulging in any malpractices such as cheating or creating dubious profiles etc., shall be disqualified from the contest at any time and shall not be eligible for any prize/gift.
• Terms and condition of Twitter and www.superdrymorgan.com shall be deemed to be a part of these Terms and Conditions.
• These Conditions shall be governed by Indian law. Any claim, legal procedure or lawsuit arising in connection with them shall solely be subject to the jurisdiction of the Courts of Mumbai.
